What personal information will be held by Atradius?

Generally, the type of personal information we collect includes your name, mailing address, telephone and facsimile numbers and email address. If you request or apply for a specific product or service we may need to collect specific information from you relating to that product or service, such as financial information. Where we have provided a product or service to you, we will need to collect and store your personal information relating to that product or service. This will enable us to assist you with any further information or questions you may have and to manage the provision of that product or service.

If you choose not to provide us with personal information we may not be able to provide the appropriate type or level of product or service to you.

How does Atradius collect personal information?

We may collect personal information in a number of ways, including:

  • directly from you by telephone;
  • in documents which we ask you to complete including those you complete online through our website and Serv@Net;
  • through third parties including related companies, credit reporting agencies, your financiers and your own representatives;
  • from other Atradius companies;
  • from sources of information publicly available;
  • from our own records of other Atradius products or services to which you do or have subscribed to; and
  • when legally required to do so.

How does Atradius use personal information?

We collect personal information to provide the products and services we offer and to manage our rights and obligations in relation to those products and services. This information is also used by us;

  • to develop and identify products and services that may interest you;
  • to conduct market or customer satisfaction research; and
  • to develop, establish and administer alliances and other arrangements with other organisations (including financiers and other insurers) in relation to the promotion, administration and use of our respective products and services.

Personal information received from third parties

If you provide personal information to Atradius about other individuals, we rely on you making those individuals aware:

  • that you may or will provide the information to another party;
  • of the purposes that the other party may or will use the personal information;
  • of the types of third parties to whom the other party may disclose the personal information and
  • of how those individuals can obtain access to personal information relating to them.

Where the personal information is sensitive, we also rely on you to obtain the consent of the individual to the above. If you have not obtained the individual's consent, you must tell us before you provide us with the information.

If we provide you with personal information about an individual, you and your representatives must only use it for the purposes for which we supply it. Where relevant, you must meet requirements set out in relevant Privacy Acts as they relate to the collection, use, disclosure and handling of personal information on our behalf. You must also ensure that your agents, employees and contractors meet the above requirements.

Can Atradius disclose personal information?

Depending on the particular product or service, we may disclose your personal information to third parties in Australia or overseas, where it is necessary to do so to enable us to provide that product or service. We may disclose your personal information to a number of third parties, including but not limited to:

  • our external advisers (for example our lawyers, accountants and auditors);
  • other insurers and financiers;
  • where we are required by law to do so.

Accuracy of information

Atradius will take all reasonable steps to ensure that the personal information it collects, discloses and uses is accurate, complete and up to date. However, we recommend that you inform us if your personal information changes or if there are any errors in the personal information you have previously provided to us.

Can you access your personal information?

Atradius will, upon request, provide you with access to your personal information, subject to any exceptions permitted by law. If we will not provide you with access to personal information or refuse to make changes to that information at your request, we will inform you of the reasons for doing so and any exception that is relied upon. Your request to provide access to and to correct personal information will be dealt with within a reasonable time.

We reserve the right to charge you the reasonable costs of retrieving and supplying the information to you.

Our privacy statement is based upon - and is compliant with - relevant privacy legislation in Australia and in New Zealand. For more information, within Australia please refer to the Privacy Act 1988 and, in New Zealand, to the Privacy Act 1993.
